I think so. I mean, every broker, every broker of any big scale has dealt with these vicarious liability claims. And I'm going to give you a little bit of Latin today because I love Latin and you deserve a little bit of Latin. Respondiat superior is this idea that the master will answer. So if you're an agent, you are an employee of somebody and you're doing your job and you cause damages, your employer is going to be on the hook, generally speaking. So when you have an independent contractor, they control what they do. They control how fast they go. They might control what uniforms they wear, what technology they use, who owns and maintains the asset. That's the independent contractor. Because this case had to deal with vicarious liability, they were saying that this driver was borrowed. And again, I don't have a— like, based on CH's statement, I'm assuming they're not lying when they say this, um, they did not exercise the kind of control that would make somebody a borrowed employee or an employee at all. So my hope is, like anything, trial courts make mistakes, that, that happens all the time. The next phase is appeals. But like the Werner Enterprises case we've been covering for a long time, it's going to be many, many years. So whatever happens at the appellate court doesn't matter because it's going to be appealed to the Texas Supreme Court, and that's where we'll have a final decision. That would be—

And so this becomes an exercise, just like we talked about the Werner Enterprises case also many months ago, was you had dead children. And it's horrifying when you have someone who has perished in something catastrophic like this and you want to do something. And so you may latch on to different facts like, oh, they were tracking the driver, over. Even like a week ago when this case first dropped, people had said, oh, I actually think that they were talking to the driver. I think C.H. Robinson spoke to the driver. And again, that's not what happened, at least according to C.H. Robinson's statement. So we'll see what happens on appeal. But my feeling is what the facts that I'm reading and learning about does not indicate to me that C.H. Robinson controlled that, that driver enough to have them become a—

We found this information before we have a final judgment. So they're still working through the process. What C.H. Robinson is likely to do is file a motion to say, hey, reconsider this judgment reconsider the liability finding. Maybe we have to appeal it, those particular things. But regardless of what happens with the trial court, we know for a fact that CH is going to appeal. And we know whatever happens on that appeal, it'll be appealed again, just like the Werner Enterprises case in Texas that went on for 4 or 5 years, millions of dollars spent, with Werner eventually being absolved of liability. The CH case is going to continue along that same process. So there's a lot of stuff that still has to happen. Before we have a final judgment and that we have a complete understanding of the facts. But what we do see, what we do know is that this is a massive verdict that has deep implications because there's only a handful of companies on the planet that can take a $600 million punch in the gut, let alone this thing is going to be going on for quite a bit.
Matthew Leffler — Freight Expectations · Will the C.H. Robinson Case Change Freight Brokerage Forever? · 2026-07-31Yeah, and the bonds vary state to state. I don't know specifically what C.H. will have to put on the, on this. The biggest concern for C.H. right now is not necessarily on the bond they might have to post for appeal. It is the post-judgment interest. As we remember the Werner case, they lost that initially at the trial court level for $90 million. They appealed it, and when they lost that first appeal the number ballooned to $130 million. So there's a thing called post-judgment interest, and it will continue to accrue somewhere between 5% and 15% or so. It depends on a bunch of different factors, but there will be a— that number increases every single day until it's eventually settled. So CH is betting big that they're going to win this as they fight this thing up. And there's one thing I admire about CH is they will fight until the very, very end. Some companies will capitulate and settle. I don't get that impression from CH. I think they're the ones that have the desire keep going. And maybe it doesn't stop at the Texas Supreme Court. There's, there's possibility, very real possibility, that this might even get up to the Supreme Court of the United States, though again, not super likely. It is possible, though.
