  1. Hello and thanks for joining us for today's edition of Wall Street Lunch. It's Monday, August 3rd. I'm Julie Morgan filling in for Kim Kahn. You can hear him all this week on Wall Street Breakfast. Our top stories so far: Peloton Interactive lost a legal case to Japanese electronics company NEC Corporation for violating its patent rights in content streaming technology. A federal jury in Delaware awarded NEC $20.5 million after agreeing with the company's argument that Peloton's bike and tread exercise equipment infringes a US NEC patent. The patent covers improved technology for distributing digital media to multiple devices simultaneously. NEC sued Peloton in 2022. Peloton tried to argue it did not infringe and that the patent was invalid. Looking ahead, Peloton will report its fiscal fourth-quarter earnings in a few days, on Thursday. Analysts forecast revenue of $597 million and EPS of $0.11 to be disclosed. 9 of the last EPS revisions from analysts have been on the downward side. Short interest on PTON stands at 14.9% of the total float heading into the report. Among other active stocks, Sportradar is down 20% after the sports technology company reported Q2 revenue that missed expectations and posted a net loss overshadowing a raised full-year outlook. GameStop is down 10% after the video game retailer agreed to exchange about $1.4 billion of outstanding convertible notes for common stock, a move that will eliminate the debt but dilute existing shareholders' stakes. eBay is down 3% after Wells Fargo downgraded the stock to underweight from equalweight and cut its price target to $92. Citing concerns that increased marketing spending at Depop to fend off competition from Vinted could pressure profitability. Looking to the economy, June construction spending is down 0.1% month-over-month versus a consensus of an increase of 0.3%. In other news of note, the European Commission disclosed on Monday that Apple has acquired materials science company Plasmasolv. The EC wrote in a statement on its website that Plasma-Solve develops solutions, including a Plasma-Solution software, to design and optimize plasma-based manufacturing processes. The acquisition happened in April. In the Wall Street research corner, Circle Internet Group is down 4% after Morgan Stanley downgraded the stock to underweight from equalweight, citing declining USDC balances. Meanwhile, TD Cowen started coverage of the stablecoin issuer with a buy rating, saying the street is underestimating Circle's evolution into a platform player.
